INTRODUCTION

The Purpose of this Agreement is to enter a coaching relationship between the Coach and the Client, where the Coach will coach the Client and cultivate his/her personal, professional and/or creative goals. 

SCOPE OF THE AGREEMENT

Coaching means personal growth coaching, personal development, life coaching in the field of career development, life coaching in the field of general health and well-being or coaching in the field of business leadership and involves working with a professional to facilitate the creation and development of personal goals and to develop and carry out a strategy and plan for achieving those goals. Other coaching services include value clarification, brainstorming, identifying plans of action, examining modes of operating in life, asking clarifying questions, and making empowering requests or suggestions for action. 

CONFIDENTIALITY

  1. The client understands that information is held confidential unless stated otherwise, in writing, except as required by law.

  2. All terms and conditions of this Agreement and any materials provided during the term of the Agreement must be kept confidential by the Client, unless the disclosure is required pursuant to process of law. Disclosing or using this information for any purpose beyond the scope of this Agreement, or beyond the exceptions set forth above, is expressly forbidden without the prior consent of the Coach.

INTELLECTUAL PROPERTY

Hereby, the Client agrees that any intellectual property provided to him/her by the Coach will remain the sole property of the Coach, including, but not limited to, copyrights, patents, trade secret rights, and other intellectual property rights associated with any ideas, concepts, techniques, inventions, processes, works of authorship, confidential information or trade secrets.

EXCLUSIVITY

The Coach and the Client agree that this Agreement is not an exclusive arrangement and that the Coach is entitled to enter into other similar agreements with other clients.

LIMITATION OF LIABILITY

In no event shall the Coach be liable for any damages for any indirect, consequential or special damages.
The Coach, hereby, makes no guarantees, representations or warranties of any kind or nature, express or implied, with respect to the coaching services negotiated, agreed upon and rendered.

ZERO TOLERANCE

  1. The Coach and the Client will remain openly committed to creating a secure, welcoming, and friendly environment, free from all racism, sexism, violence, bullying, and any form of sexual, physical, verbal or emotional abuse.

  2. The Coach will take seriously any threatening, abusive or violent behaviour, and these behaviours will not be tolerated under any circumstances. If a Client is threatening, abusive, or violent, they will be asked to stop. If the Client persists, the Coach may take action to end the session and have the Client removed, immediately if necessary, from our list of members. There is no appeal process. Any incident of threatening, abusive or violent behaviour may be reported to the local police service at the sole discretion of the Coach. 

RESPONSIBILITIES

  1. Coaching requires a co-active, collaborative approach and does not guarantee success in the pursuit of individual goals. In the coaching relationship, the Coach plays the role of a facilitator of change. It is the Client's responsibility to enact or bring about the change. 

  2. Coaching conversations may address specific personal projects, career successes or general conditions in an individual’s life or profession.

  3. Coaching conversations may involve all areas of life, including family, work, finances, health, relationships, education and recreation, and the Client acknowledges that deciding how to handle these issues, incorporate coaching into those areas and implement choices is exclusively their responsibility.

  4. Coaching is not the same as counselling or therapy. The focus of coaching services are non-clinical. A person works with a coach, who is not a healthcare provider, to clarify goals in order to create action plans to achieve desired results. Coaching is not a substitute for counselling, psychotherapy, psychoanalysis, mental health care or substance use treatment and should not be used in place of any form of diagnosis, treatment or therapy. 

  5. The Client acknowledges that if they are currently in therapy or otherwise under the care of a physician or mental health professional, the Client has consulted with the care provider regarding the advisability of working with a coach and that this person is aware of the Client's decision to proceed with a coaching relationship. 

  6. The Client acknowledges that goods and services are not a substitute for legal, medical, financial, business, career or spiritual advice and the Client is required to seek independent professional guidance for these matters, and all decisions and actions in these areas are exclusively the Client's own responsibility. 

  7. If any personal crises or emergencies arise (physical, mental, emotional or spiritual) during the course of the coaching relationship, the Client must notify the Coach immediately, in writing, so that the Coach may discuss with the Client appropriate steps for referral if needed.

  8.  Should the Client require emergency medical treatment as a result of an accident or illness arising during the coaching relationship, the Client consents to such treatment and acknowledges that the Coach does not provide health and accident insurance and the Client agrees to be financially responsible for any medical bills incurred as a result of emergency medical treatment. The Client will notify the Coach in writing if they have any medical conditions about which emergency medical personnel should be informed.
